PrEP Access Updates

Key updates to PrEP access include recent changes to state and federal law and policy. This summary includes changes likely to affect PrEP access in California.

Update: In Kennedy v. Braidwood the U.S. Supreme Court has held in that members of the USPSTF were appointed properly according to the U.S. Constitution. Thus, the committee’s preventative health recommendations that the Affordable Care Act requires plans to cover free of cost-sharing remain in effect including the Grade A recommendation for PrEP. The decision also clearly states that moving forward, the Secretary of the Department of Health and Human Services has the authority to remove Task Force members, appoint new Task Force members and can directly review Task Force recommendations before they take effect. Various avenues remain for the administration to block existing and future Task Force recommendations, keeping this issue a likely subject for ongoing litigation.
